You have connected to the Career Portal for Akamai Technologies, Inc. and its affiliates (collectively, "Akamai") and are in the process of entering and transmitting personal data. Akamai recognizes your right to confidentiality and is committed to protecting the privacy of your data in accordance with applicable data protection laws.
By creating a profile, and submitting your resume or curriculum vitae or other documents, you will be participating in the selection procedure for the specific position you have selected. In addition, your submission may be reviewed for general consideration against employment opportunities at Akamai. The data you provide via the Akamai Career Portal and in connection with your application for employment with Akamai and any other personal data you provide to Akamai separately may be reviewed at any time by an authorized representative of Akamai but will be treated as confidential. You represent that the data you provide is complete and accurate. Authorized representatives may include Akamai employees within the responsible Akamai departments and Akamai agents, service providers and consultants who are involved in the hiring process and have a legitimate need to access and process your data for the purpose of identifying and evaluating your submission for employment opportunities at Akamai and contacting you in relation to such opportunities.
Personal data you submit may be transferred from locations outside of the U.S. to Akamai or its authorized representatives in the U.S. and to any other country where Akamai or its authorized representatives may operate from time to time for the purposes described herein. Currently, all online submissions are transferred to, and stored and maintained in, Akamai’s central database hosted in the United States by our third party service provider, iCIMS. iCIMS complies with the Safe Harbor framework developed by the U.S Department of Commerce and the European Commission. Akamai will retain your personal data as long as necessary for the purpose of evaluating your qualifications for employment as well as to comply with applicable laws. You may modify or change your profile at any time. In addition, you have the option at any time to request that your personal data be deleted from our database entirely by sending an email to: careers@akamai.com with “Profile Deletion” in the subject line. On the candidate profile page of the Akamai Career Portal, you will be required to affirmatively acknowledge and consent to the terms of this Applicant Privacy Statement & Arbitration Agreement by selecting “Yes” where prompted. This consent shall relate to the personal data contained in the relevant application for employment with Akamai and the creation and management of an applicant profile in the Akamai Career Portal. If you do not consent, your data will not be considered for employment opportunities and you will not be able to proceed with the online application process. Arbitration Agreement (U.S. only)
Any and all disputes concerning or arising out of employment at Akamai (including but not limited to your application, hiring, and termination from employment) that cannot be otherwise resolved shall be submitted to binding arbitration before a single neutral arbitrator of the American Arbitration Association (“AAA”) under the AAA’s Employment Arbitration Rules. Akamai will pay the AAA administrative and arbitrator fees as to statutory claims and to the extent otherwise required by law for enforcement of the agreement to arbitrate, subject to final assessment by the arbitrator. The arbitrator shall not have the power to commit errors of law or legal reasoning, and the arbitrator’s order, decision or award may be vacated or corrected on appeal to a court of competent jurisdiction for any such error. Otherwise, the arbitrator’s order, decision or award shall be final and conclusive, in lieu of all other legal, equitable or judicial proceedings between us, and that order, decision or award may be entered as a final judgment in, and enforced by, any court of competent jurisdiction. Notwithstanding the foregoing, the parties shall have the right to seek provisional remedies provided by law, including temporary restraining orders and preliminary injunctions, from a court of competent jurisdiction pending arbitration.
With the exception of claims covered by Section 8116 of the Department of Defense Appropriations Act, 2010, which are excluded from arbitration under this agreement, this arbitration agreement specifically includes, without limitation, all disputes, under any state or federal discrimination, fair employment practices or other employment related statute, regulation or executive order (as they may have been amended) prohibiting discrimination or harassment based upon any protected status including, without limitation, race, national origin, age, gender, marital status, disability, veteran status or sexual orientation or other protected status; all claims for unlawful retaliation for exercising any right under law; all torts; all federal or state statutory claims; and all express or implied contracts. Any third party who creates a profile in the Akamai Career Portal will be deemed to have represented that such third party has the full power and authority to do so and to provide personal data of an applicant in connection therewith, and to agree and consent to the Applicant Privacy Statement & Arbitration Agreement on behalf of the applicant. Furthermore, you, as the applicant, understand and agree that by providing personal data and other information to an Akamai representative for consideration for employment at Akamai through a third party or otherwise, such personal data and other information may be submitted into the Akamai Career Portal subject to the terms of this Applicant Privacy Statement & Arbitration Agreement and you will be deemed to have agreed to the terms of this Applicant Privacy Statement & Arbitration Agreement.
